Itawamba County Schools in Mississippi have a policy which states that all prom dates must be of the opposite sex. Constance McMillan a Lesbian Senior is now challenging that. McMillan wanted to bring her girlfriend to the prom, instead of denying the request Itawamba County Schools simply cancelled the prom. As you might imagine, the ACLU has filed suit on behalf of Constance McMillan.
The ACLU had given the school system until Wednesday to reinstate the prom, they’ve refused and the lawsuit goes on. Constance McMillan chose to fight against the ban on same sex dates at the prom; who knew the school board wouldn’t have the stomach to fight the fight. Amazingly they simply cancelled the prom, disappointing not only Constance McMillan but every other student who was slated to go.
In this day and time the school board in Itawamba County Mississippi had to realize they weren’t going to get away with a draconian policy stating what type of date a person could bring to the prom. Whatever your morals and standards you must be realistic. Had the school system simply allowed Constance McMillan’s Lesbian date to attend with her they would have avoided a mountain of legal trouble that they are now embroiled in; not to mention the bad press.
The school board indicated that they chose to cancel the prom because of the “distraction” that the Constance McMillan situation was becoming. They stated that they were taking into account the education, safety, and well being of all the students. Constance McMillan disagrees:
“All I want is the same chance to enjoy my prom night like any other student. But my school would rather hurt all the students than treat everyone fairly,” “This isn’t just about me and my rights anymore — now I’m fighting for the opportunity of all the students at my school to have our prom.”
You just know that the Constance McMillan Lesbian High School prom problem has school boards all over the country searching their policies with a fine tooth comb, probably making changes where necessary. Nobody, especially a school board wants to find themselves in the crosshairs of the ACLU over an issue like this. This is a fight the school board will not win.

Maybe I am not as progressive as the rest of the crowd, but this is difficult for me to understand. I am so conflicted with the issue of gay rights. I want equallity for all, but I feel like this is being shoved in my face at every turn, and I find it confusing and annoying at times. It is too bad that the students will be disappointed, can they move the prom to another local? or take a student vote and let the majority rule.

If you believe in equality for all, you should do some reading and weigh the situations that LGBT people have to deal with…simply because of the way we were born…then add the pressures and trials of life (in general) onto that. She is also suing for not being able to wear a tux. Good for her. I wore a tux to my Junior prom, and I am straight. I wore it as a symbol for my gay friends and loved ones. I am from a very small town and no one had ever done anything like it before, but no one cancelled prom JUST because of me. I was actually supported for it. My date (who was gay and my best friend) and I wore matching tuxes, and it was fantastic. Our school just asked me if I was going to be wearing “formal wear.”

On the other issue, MCCain, you are dead wrong. There are still beatings at schools due to the fact that a person was gay. To the point that hate crime laws have been used to prosecute the students. The issue is one that is still on the front burner through out the US. Equal rights for every American, not just those with the “correct” sexual preference. While I do not want the “in your face, this is my life style, deal with it” attitude I do think that everyone has the right to their life style as long as it is not imposed/forced on anyone else. I’m all for equal rights, and I think there is plenty of room for improvement in the legal treatment of homosexuals. But the federal hate crime stuff really scares me.
Not only does it violate the very idea of equal protection under the law, but it opens the door far too wide for double jeopardy and other prosecutorial abuses. No matter how well-intentioned, hate crime legislation grants the government power it should not be given. Unintended negative consequences cannot be avoided with that sort of arrangement.
Visiting violence upon another citizen is a crime in every state and at the federal level, no matter what the motivation. The despicable thugs who murdered Matthew Shephard are rotting in jail like they should be because of these long-standing laws. Let’s keep enforcing them instead of trying to pass redundant laws that remove important limits on government prosecutorial power.

That’s fair enough as far as it goes, but as a public institution the school has a legal obligation to avoid discriminatory practices. If this were a private school, I’d be in complete agreement. But this is something different.
Unless they want to prohibit students from bringing dates to the prom, they really have no right to prohibit homosexual students specifically from doing something they allow heterosexuals to do.

First of all, there’s a current push in Europe (France, The Netherlands, etc) to prohibit zoosexuality, so I’m not sure the trend is going in the direction you indicated. Besides, this is the US — too much cultural resistance here. And hey, if by some chance it were legalized by a democratic process, yeah I’d support maintaining those established rights for all citizens including school children.
Without a legal distinction, public schools should not be allowed to make a policy distinction. Simple as that.

God bless the school board. Canceling the prom is the right thing to do. Kids don’t have a constitution “right” to a prom anyway, it is not part of any education curriculum that I know of. The ACLU has no legal leg to stand on, so IF they win, it will because of someone’s opinion, NOT because of constitutional law.

I think I’m a pretty open minded person, but I can see why highschool’s or people in general discriminate gays/lesbian/homo. 1 it tempts other highschoolers to try out homosexuality and it gives the impression that the school is for it.
Pluss, homosexual’s have generaly more than one mate(some straight people do too) and really honestly is that a healthy lifestyle. Some gay’s are gay and they don’t want to be, I beleive homosexuality is a struggle and problem for some people. Everybody goes threw obstacles that they have to conquer.
Its not natural being “gay”, your not born “gay”. God made woman for man & man for woman! You can just tell by how man and woman connect pysicaly and emotionaly.

I never really understood the animosity most on the right have for the ACLU. The organization is actually very consistent in its application of constitutional law, and will stick up for so-called “conservative” causes just as quickly as so-called “liberal” causes.

The school needs to know that this bigoted behavior is unacceptable. Let them know how you feel.

yeah well Rhayader, you might want to take into consideration some of the cases the ACLU has approached or decided to take into considering defending
Do you have any specific examples in mind besides a NAMBLA case that they didn’t even participate in?
Theres not too much doubt after looking at their history that they are a left leaning organization
I think it’s more likely that, since their inception, the majority of suppression of civil liberties has come from “the right”. That’s not exactly a problem with the ACLU.
The rights they seem to lok out for most of the time seem to be the rights that those on the left are hunting for…
Maybe because the people on the left are the only ones who even pretend to care about constitutional civil liberties any more?

The only thing that frustrates me is knowing what would have happened had the school board said “o.k.” … they still would have had to deal with parents who chose to have a freak-fit about that, and this story would still be in the news. I guess that’s what frustrates me more than anything … no matter what ends up happening here, right now, we are still at a place where a girl wanting to go to her prom with another girl is this divisive and newsworthy. I’d really rather just say, “cool, do what you want to do, dance with who you want to dance with, and then tomorrow morning, after the dancing is over, let’s work together to help out kids who are being neglected/abused or who don’t have access to education.” Truthfully, that’s my main desire for equality … so we can all just shut up about this minutia crap of who sleeps with who and what genitals go where and instead make a difference in the world to those who are starving, physically sick, etc.
