New Afghan Law is Legal Rape

A new Afghan law, which reportedly was never debated in parliament, makes it legal for a man to rape his wife should she refuse to have sex with him. One of the articles of this law has a provision that a woman cannot leave her home without her husband’s permission. And if it’s possible to make this worse, this egregious law says that the wife ‘is bound to preen for her husband as and when he desires.’ Here’s more:

“As long as the husband is not traveling, he has the right to have sexual intercourse with his wife every fourth night,” Article 132 of the law says. “Unless the wife is ill or has any kind of illness that intercourse could aggravate, the wife is bound to give a positive response to the sexual desires of her husband.”

Human rights groups and a few thinking Afghan politicians are going nuts over this law. Many say President Hamid Karzai, who signed this insane piece of legislation, is taking steps back to the dark days of the Taliban simply to get re-elected later this year. By signing this, he is accused of courting the more conservative Shiite vote.

The brutality of the Taliban toward women is well documented. The government that ruled Afghanistan, welcoming Osama Bin Laden and his terrorists with open arms, banned women from appearing in public without a body-covering burqa and a male escort from her family. The concept that we women are full human beings with human rights is completely distasteful to them.

Since the fall of their government, much in Afghanistan for women has improved. Millions of girls now attend school and many women own businesses. Of the 351 Afghani parliamentarians, 89 are women. But Afghanistan is still a very conservative country and this law simply undermines all those gains. It also directly contradicts the freedoms guaranteed in the Afghan constitution, and the international conventions signed to guarantee the rights of women in that country.

Many American military and our allies have paid, and continue to pay, a high price for Afghani women to be free. Laura Bush was even their champion. What is Hamid Karzai doing throwing that away? And what will Barack Obama do about this? Do they realize this is really, really dangerous for everybody in Afghanistan?
