James Fagan is a Democratic Massachusetts State Representative who has angered many people by arguing against Jessica’s Law by saying as an attorney he would rip 6-year-old children apart. Read about it below, see photos and see a video of his rant.

Democratic Representative James Fagan represents the people of Taunton, Massachusetts. He is a Massachusetts criminal defense attorney by trade and has been opposing the implementation of Jessica’s Law. This law that would set mandatory minimum sentences for child rapists. As I’m sure you know, the law is named after Jessica Lunsford, a 9-year-old Florida girl who was brutally raped over a series of days and then buried alive in a garbage bag by her murderer. The man who did this to Jessica was a repeat sex offender.

The Massachusetts representative was so adamant in his opposition to this mandatory sentencing law that he took to the floor of the House and called it ‘knee-jerk legislation’. He said the mandatory sentences were of ‘draconian proportions.’ He said as an attorney he would …..

“rip apart�? 6-year-old victims on the witness stand and “make sure the rest of their life is ruined.�?

In a fiery soliloquy on the House floor, Fagan said he’d grill victims so that, “when they’re 8 years old they throw up; when they’re 12 years old, they won’t sleep; when they’re 19 years old, they’ll have nightmares and they’ll never have a relationship with anybody.�?

Sounds like a really nice guy. Talk about having sympathy for the devil! He even gives criminal defense attorneys a bad name.

The people of Taunton elected this guy. I can’t help but wonder if they are still glad he represents them. I wonder how much longer he’ll have his job. Three …. two ….. one ……

Mark Lunsford, Jessica’s father, was understandably outraged. He said it is insulting to him to put his daughter’s name on a watered down version of the law. Lunsford is in Massachusetts to push for inclusion of the mandatory sentences.

“Why doesn’t he figure out a way to defend that child and put these kind of people away instead of trying to figure ways for defense attorneys to get around Jessica’s Law?�? Lunsford told the paper. “These are very serious crimes that nobody wants to take serious. What about the rights of these children?�?

The ‘draconian’ sentencing that Fagan railed against are between 10 and 15 years for a set of different offenses against children ranging from assault to sexual crimes. Ten to fifteen years for sexual assault against children? When I think of draconian sentencing, I think that MAYBE being drawn and quartered and disemboweled might be a little over the top. Maybe.

James Fagan Biography

James Fagan graduated from Monsignor James Coyle High School. He then graduated from Bridgewater State College in 1969 and Suffolk University Law School in 1973. He is a criminal defense attorney. He has been a member of the Massachusetts House of Representatives since 1993. He serves on as Chair of the House Committee on Ethics and serves on the House Committee on Rules, the Joint Committee on Health Care Financing and the Joint Committee on State Administration and Regulatory Oversight.
